16.9 Part Four – The Insured's Duties if Injury Occurs

If a workplace injury occurs, the employer has several responsibilities under the policy. The employer must:

  • Provide any immediate medical care required by state law.
  • Report the names and addresses of the injured employee and any witnesses to the insurer.
  • Promptly forward all injury-related notices, legal documents, and demands to the insurer.
  • Cooperate with the insurer during the investigation, settlement, or defense of the claim.
  • Protect the insurer's subrogation rights by not interfering with its ability to recover damages from a responsible third party.
  • Avoid voluntarily making payments, assuming obligations, or incurring claim-related expenses unless done at the employer's own expense.
